transcriptions.app provides automated audio transcription services powered by frontier AI models. The Service includes:

• Audio file upload and processing
• Automated transcription using AI technology
• Download and access to transcribed text
• Temporary storage of uploaded files and transcriptions

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload content that violates any laws or regulations
• Upload content that infringes on intellectual property rights
• Upload malicious files or attempt to harm the Service
• Attempt to bypass payment or access restrictions
• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws in your jurisdiction

4. User Content

You retain all rights to the content you upload to the Service. By uploading content, you grant us a limited license to process your content solely for the purpose of providing transcription services.

You represent and warrant that:

• You own or have the necessary rights to the content you upload
• Your content does not violate any third-party rights
• Your content is not illegal, harmful, or offensive

5. Payment Terms

Our pricing structure is transparent and usage-based:

• Files under 30 minutes: €1.00 flat fee
• Files over 30 minutes: €1.00 base + €0.06 per minute for time exceeding 30 minutes
• All payments are processed securely through Stripe
• Payments are required before transcription processing begins
• Prices are subject to change with notice

6. Refund Policy

We strive to provide accurate transcriptions. Refunds may be considered on a case-by-case basis for:

• Technical failures preventing transcription delivery
• Significant quality issues with the transcription

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by transcriptions.app and is protected by international copyright, trademark, and other intellectual property laws.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as detailed in the Privacy Policy.

9. Disclaimers and Limitations

9.1 Service Accuracy

While we strive for high accuracy, automated transcription may contain errors. The Service is provided "as is" without warranties of any kind regarding accuracy or completeness.

9.2 Limitation of Liability

To the fullest extent permitted by law, transcriptions.app shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless transcriptions.app from any claims, damages, or expenses arising from your violation of these Terms or your use of the Service.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for:

• Breach of these Terms
• Conduct that we believe violates any applicable law
• Conduct harmful to other users or the Service

These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.
